Officer Darren Wilson is now recalling that he had a major struggle with Michael Brown in an SUV before he shot the unarmed teen to death.

The Ferguson, Missouri, cop recently told authorities that he feared for his life as Michael pinned him in his vehicle during the early August incident.

According to the New York Times, Darren told investigators that Michael punched and scratched him during their scuffle in the vehicle, where the teen supposedly grabbed for his gun. Darren claims that his firearm went off twice during their fight in the SUV, and one of the bullets struck Michael in the arm. The officer himself claims that Michael left scratches on his neck and caused some swelling in his face.

Darren made the claims during the grand jury that convened in his case to decide if there is probable cause that he committed a crime when he shot Michael. While investigators did find evidence in to support Darren’s recollection of a struggle in his SUV—Michael’s blood was found on a door panel, the officer’s gun and his uniform—this doesn’t explain why he fired at Michael after they got out of the vehicle. This account also doesn’t line up with what some witnesses have told authorities.

Testimony about a fight in his vehicle could help Darren’s case in that it may frame his state of mind during the altercation. Still, there is the possibility that prosecutors could argue that Darren started the fight.

One key witness to the case is Dorian Johnson, who was walking down the middle of a road with Michael when Darren approached them in his SUV. “He just reached his arm out the window and grabbed my friend around his neck, and he was trying to choke my friend,” Dorian told reporters. “He was trying to get away, and the officer then reached out and grabbed his arm to pull him inside the car.”

It’s unclear how this testimony could sway the grand jury, which has been meeting since August 20. Prosecutors are expecting a final decision by the middle of November.
