Bernie Mac’s widow, Rhonda McCullough, has dropped a wrongful death lawsuit against the late star’s longtime doctor following Mac’s untimely death in 2008, the Chicago Tribune reports.

McCullough filed the lawsuit in 2010 in Cook County Circuit Court, charging that dermatologist Rene Earles failed to recognize her husband’s signs of respiratory distress during a procedure some weeks before Mac died from complications of pneumonia.

McCullough charged that instead of calling an ambulance to take her 50-year-old husband to the hospital at the time, Earles kept him at his clinic for several hours.

While the Tribune could not reach McCullough, her lawyer, Cannon Lambert Sr., said that they specifically asked the judge to dismiss the case in a way that allows them to refile it within a year. He charged that there were “a lot of things [Earles] was required to do in this that he didn’t do.”

He declined to elaborate further on the case.

Saying the suit “never should have been filed,” Earles told the Tribune Wednesday that the suit “had an extraordinarily negative effect” on his career and that he is glad it has been dismissed.

“It never should have been filed,” Earles told the paper. “I am not responsible for Bernie Mac’s demise. It is just the truth.”
